GoRage Terms and Conditions
RomânăWorking draft. The fields highlighted in yellow are filled in with the company details, and the text is reviewed by a lawyer before launch.
Effective date: [DATA INTRĂRII ÎN VIGOARE]. Version 1.0.
These Terms and Conditions (the "Terms") govern your use of the GoRage mobile app for iOS and Android and the related web pages (together, the "Service"). By creating an account or using the Service, you confirm that you have read and accept these Terms. How we process personal data is described in the GoRage Privacy Policy, available in the app and at gorage.app/privacy.
1. Who we are and how to contact us
The Service is provided by [DENUMIRE SOCIETATE], a Romanian company with its registered office at [SEDIU], registered with the Trade Register under no. [Nr. Reg. Com.], tax identification code [CUI] ("GoRage", "we", "us").
- Email (questions, complaints, requests): contact@gorage.app
- Phone: [TELEFON CONTACT]
- Data protection: contact@gorage.app
- Website: gorage.app
- Single point of contact under Regulation (EU) 2022/2065 (Digital Services Act): contact@gorage.app, for users and for authorities (Member States, the European Commission, the European Board for Digital Services). We communicate in Romanian and English, and replies are not given solely by automated means.
2. Definitions
- App — the GoRage mobile app and its updates.
- Driver — an individual who uses the Service to find and contact automotive businesses.
- Guest — a person who uses the App without an account.
- Business — a company (legal entity or other tax-registered professional) offering automotive services or products that has a business account on GoRage.
- Location — a physical site of a Business, shown separately on the map.
- Content — any text, photo, logo, price, review, message or other material uploaded to the Service.
- Status Page — the page in the App that shows a Driver, in real time, the progress of work on their car while it is with a Business on Garage Pack.
- Store — the Apple App Store or Google Play, as applicable.
3. Acceptance, minimum age and eligibility
- The Service is not intended for persons under 16. To create a Driver account you must be at least 16 years old, and we ask you to confirm this when you sign up.
- A Business account may only be created by a person aged at least 18 who acts on behalf of a company and is authorised to represent it. By creating the account, the company becomes a party to these Terms.
- You may not use the Service if we have permanently closed your account for breaching these Terms or if applicable law prevents you from doing so.
4. Your account
- You can sign up with email and password, phone number and password, Sign in with Apple or Google. You can browse the map without an account as a Guest, but some features (cars, bookings, requests, chat, reviews) require an account.
- You must provide accurate information and keep it up to date. An account belongs to a single person or company and cannot be transferred.
- Keep your password confidential. We store it only as a salted cryptographic hash, so we cannot see it.
- Tell us immediately at contact@gorage.app if you suspect unauthorised access to your account. You are responsible for activity in your account, except where unauthorised access is our fault.
5. The role of GoRage
- GoRage is an online platform that helps Drivers find automotive Businesses, view their profiles, book appointments, send repair requests and communicate with them.
- We are not a garage and we do not provide the services shown in the App. The contract for any service or product (repair, roadworthiness test, tyre work, parts, car wash, etc.) is concluded directly between the Driver and the Business. GoRage is not a party to that contract and does not act as agent for either party.
- All Businesses with an GoRage account are traders. You exercise your consumer rights regarding the service or product you buy (information, conformity, warranty, tax documents) against the Business.
- Prices, opening hours, descriptions and photos in profiles are published by the Businesses, which are responsible for their accuracy. Prices may be fixed or indicative and are marked as such. The final price is agreed between you and the Business, usually after the problem has been diagnosed.
- We check that the company exists before a Location goes public (section 12), but we do not guarantee the quality of the services or the accuracy of all information published by Businesses.
- Some map information (streets, addresses, points of interest) comes from OpenStreetMap (© OpenStreetMap contributors, ODbL licence) or other public sources and may be incomplete or out of date. The map may also show places without an GoRage account, which we do not verify. Check the address and opening hours before you travel. If you represent such a company and want the information corrected or removed, write to us at contact@gorage.app.
6. Use of the Service by Drivers
- Cost — The Service is free for Drivers. Any future paid features will be announced in advance and will apply only if you choose to buy them.
- Map and location — With your permission, we use your device location only while the App is in use, to show you nearby businesses. You can refuse or withdraw permission at any time in your phone settings and search manually by city or address.
- Your cars — You can add cars (plate number, make, model, year, colour, optional VIN and photos). Add only cars you own or are entitled to use or manage.
- Bookings — A booking made through the App is a request to reserve a time slot with the chosen Business. The Business may confirm, reschedule or decline it, and you receive a notification. If you can no longer make it, cancel in good time. Repeated no-shows may lead to restrictions on the booking feature.
- Repair requests — Your description and photos are sent to Businesses in the area you choose. They may reply, for example with an estimate. An estimate is not a firm offer unless the Business explicitly says so, and you are not obliged to accept it.
- Chat — Use chat only for communications about the services requested. The Business you talk to sees the messages and may keep them for its own records.
- Status Page — While your car is with a Business on Garage Pack, you see in the App, in real time, the status of the job (booked, checked in, in progress, ready for pickup) and the list of works. The Business updates the status. The page is visible only in your account, not through a public link.
- Driving mode ("Drive now") — The App can guide you to a Business with on-screen and voice instructions. Routes, distances, times and speed limits shown come from public data (OpenStreetMap) and are for information only: they may be incomplete or out of date. Traffic signs, police instructions and traffic rules always take priority. Start guidance before you set off, mount your phone in a holder and do not handle the App while driving. Without internet, the App works out an approximate route on your phone from the saved map (without turn restrictions or traffic information); where the map is not saved, it only shows the direction to your destination.
- External navigation and WhatsApp — You can also open navigation in Apple Maps, Google Maps or Waze, and WhatsApp contact opens in the WhatsApp app. These are third-party services with their own terms.
7. Reviews and ratings
- You may leave a review only from your account and only about a real, personal experience with that Business.
- The following are prohibited: false or misleading reviews; reviews of your own company, a company you are connected to or competitors; reviews given in exchange for payment, a discount or another benefit; pressuring clients to post or remove reviews; reviews with illegal or abusive content or with other people's personal data.
- How we check reviews: a review can only be posted from your account, after a booking made through GoRage with that Business has been completed (car picked up), one per booking. We do not pay for or reward reviews. We examine reported and suspicious reviews, with human review. We do not check the content of every review before publication.
- We do not remove a review just because it is negative. A Business may report a review it considers illegal or contrary to these Terms, and we will assess it under section 11.
- The rating shown for a Location is the average of the published ratings for it, together with their number.
8. Rules of conduct
When using the Service, you must not:
- publish content that is illegal, misleading, defamatory, threatening, harassing, obscene or that incites hatred or violence;
- infringe the rights of others (copyright, trademarks, privacy), for example by publishing someone's personal data without a lawful basis;
- create fake accounts, Businesses or Locations or impersonate anyone;
- send spam or bulk messages;
- automatically extract data from the Service (scraping) or build databases of Businesses, prices or reviews;
- circumvent security measures, upload malware or interfere with the operation of the Service;
- create new accounts to get around a suspension or use the Service for illegal purposes.
9. Your content
- Content you upload remains yours or belongs to those who granted you the rights.
- You grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, technically adapt (resize, compress, crop for display), display and publish that Content in the App and on the Service's public web pages (for example, the Business profile), for as long as the Content is in the Service and for the time needed to delete backup copies. We may allow our technical providers to process it only for this purpose.
- For Businesses, the licence also covers using the name, logo and profile photos in materials showing that the Business is present on GoRage. You may refuse this promotional use at any time by emailing contact@gorage.app.
- You warrant that you have the necessary rights to the Content you upload and, where applicable, the consent of the people shown in it. Please hide the faces of people and the plate numbers of other cars appearing in photos.
- If you send us suggestions or ideas, we may use them without any obligation to you.
10. Intellectual property and licence to use the App
- The App, its design, code, the GoRage name and logo belong to [DENUMIRE SOCIETATE] or its licensors.
- We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use the App on devices you own or control, in accordance with these Terms and the Store's usage rules. Businesses may use the App for their own business activity.
- You may not copy, modify, decompile or reverse engineer the App, except where expressly permitted by law, nor rent, sell or distribute it.
- The App uses third-party components, including open-source software under its own licences, map data © OpenStreetMap contributors, OpenFreeMap / OpenMapTiles map tiles and the vehicle model list from the public NHTSA vPIC database.
11. Reporting illegal content and moderation
- You can report any Content you consider illegal or contrary to these Terms using the report button in the App or at contact@gorage.app. Include the reasons, the exact location (the Business, review, photo or link), your name and email (not required for reports concerning child sexual abuse) and a statement that the information is accurate and complete to the best of your knowledge.
- We confirm receipt, assess the report diligently, objectively and without undue delay, then tell you our decision and whether we used automated means.
- Moderation tools: user reports, human review, automatic filters for spam and vulgar language, and verification of companies and Locations. The measures we may take are: removing or hiding Content, limiting certain features, suspending or closing the account, refusing or withdrawing verification of a Location.
- Statement of reasons: when we restrict your Content or account, we send you a clear statement of reasons covering the measure taken, the facts relied on, whether automated means were used, the legal ground or the provision of these Terms breached, and how you can challenge the decision.
- Challenge: you can challenge any decision within 6 months, free of charge, by replying to our message or writing to contact@gorage.app. Your challenge is reviewed by a person, not only by automated means. You may also go to court at any time.
- You can block and report another user or a Business directly from the conversation.
- If someone repeatedly submits manifestly unfounded reports or repeatedly publishes manifestly illegal content, we may, after a warning, suspend the processing of their reports or their account for a reasonable period.
- If we become aware of a possible criminal offence threatening a person's life or safety, we inform the competent authorities.
12. Business accounts
12.1 Eligibility and verification
- Business accounts are only for companies lawfully carrying out an automotive activity. A valid tax ID is required (in Romania, the CUI). In the future we will also accept companies from other countries.
- Each new Location is verified by GoRage before it goes public. Verification may include checking the company's public data by CUI (for example, through the public ANAF service) and a human review. We may ask for documents proving that the company exists, that the person creating the account is entitled to represent it, and that the company is connected to the Location's address.
- We may refuse or withdraw verification if the data cannot be confirmed, is false or the company is no longer active. We will tell you the reasons.
12.2 Public profile and prices
- You publish photos, logo, address and map pin, opening hours, description, services and prices. You are responsible for all of this being accurate, up to date, not misleading and compliant with consumer protection and price indication law.
- Clearly mark fixed and indicative prices. A fixed price displayed must be honoured under the conditions described.
- Use only photos and logos you hold the rights to and that show the Location as it really is.
- We may display the company name and CUI on the public profile, so Drivers know whom they are contracting with.
12.3 Authorisations and relationship with clients
- You are responsible for holding and maintaining all authorisations, certifications and approvals required by law for your activity (for example, for roadworthiness test stations or for handling refrigerant gases).
- You are responsible for the services you provide, warranties, tax documents, handling your clients' complaints and honouring confirmed bookings. Keep your calendar up to date so the slots shown are real.
- You use client data received through the Service only for the services they requested and for your legal obligations. You do not use it for marketing without a lawful basis.
13. Business subscriptions
- Garage Pack — €49.99/month — calendar and bookings, requests from Drivers, chat, Status Pages, public profile with services and prices.
- Spotlight Pack — €9.99/month — presence on the map and a public profile with photos, opening hours, prices, phone and navigation, without bookings.
Subscription terms:
- Coverage — The subscription is paid once for the whole business and includes any number of Locations at no extra cost.
- Price — The prices above are reference prices in euro. The exact price in your country's currency, including applicable taxes, is shown by the Store before purchase.
- Free trial — Both packs start with a 14-day free trial, offered once, in accordance with the Store's rules. At the end, the subscription automatically becomes paid unless you cancel before the trial ends.
- Payment and renewal — Subscriptions are sold through the Apple App Store or Google Play as auto-renewing monthly subscriptions. Payment is made through your Store account. The subscription renews every month at the current price until you cancel. We do not receive or store your card details.
- Cancellation — Cancel from your Store account: on iPhone, in Settings, under your name, then Subscriptions; on Android, in Google Play, under Payments and subscriptions, then Subscriptions. Access continues until the end of the paid period. Deleting the App or your GoRage account does NOT cancel the subscription.
- Refunds — Refunds for Store purchases are handled exclusively by Apple or Google under their policies. We cannot issue refunds for these purchases.
- Restore purchases — On a new device or after reinstalling, use the "Restore purchases" option in the App.
- Price changes — We will notify you at least 30 days before any price increase. The Store may ask for your consent under its rules. You can cancel before the new price applies.
- No right of withdrawal — Subscriptions are bought for business purposes, so consumer withdrawal rules do not apply.
- Non-payment — If payment fails, the Store may apply a grace period. After that, the pack's features are deactivated and the profile is no longer shown publicly.
- Payment documents — For Store purchases, proof of payment is issued by Apple or Google. [TO BE CONFIRMED with the accountant]
- Direct invoicing — Subscriptions invoiced directly to companies, if we offer them, will have separate commercial terms communicated before ordering.
14. Ranking on the map and in search results
Only Locations verified by GoRage appear on the map and in search. A Location under review does not appear at all. Places from public sources (OpenStreetMap) without an GoRage account appear separately, with basic information only.
The main parameters that determine the order in which you see Locations are, in order of importance:
- distance from your location or from the area you chose;
- match with the category, filters (for example "open now") and search text;
- average rating and number of reviews, when you choose to sort by rating.
We do not accept payment for a better position in results. Garage Pack and Spotlight Pack are treated the same in ranking; the difference between them is only the features included. If we ever introduce promoted placements, they will be clearly labelled "Promoted" and these Terms will be updated beforehand. GoRage does not offer its own automotive services competing with Businesses.
15. Data and access to data
- We process personal data in accordance with the Privacy Policy. For account and App data, GoRage is the controller.
- A Business has access to the data provided by the Drivers who choose it (name, phone, car details, descriptions, photos, messages, bookings) and to the data it enters itself. It has no access to data of Drivers who have not interacted with it.
- We do not sell data and we do not use a Business's client data for our own purposes.
- You can request a copy of your Business account data, in a commonly used format, before final deletion, including during the 14 days after deactivation.
16. Data processing agreement for Businesses (Art. 28 GDPR)
For client data that a Business manages in the Service (bookings, clients, cars, Status Pages, including manually entered data), the Business is the controller and GoRage is the processor. This section constitutes the contract required by Article 28 of Regulation (EU) 2016/679 (GDPR).
- Subject matter and duration — hosting and processing the data needed to operate the Service, for the duration of the Business account and until the data is deleted under section 18.
- Nature and purpose — storage, organisation, display, sending notifications and messages, showing job progress (the Status Page), backups.
- Types of data — name, phone, email, car details (plate number, make, model, year, colour, VIN), photos, bookings, works, statuses, messages.
- Data subjects — the Business's clients and prospective clients, and its employees or collaborators using the account.
- Instructions — we process the data only on the Business's documented instructions, given through these Terms and the App settings, unless the law requires otherwise. We tell you if an instruction appears to us to infringe the law.
- Confidentiality and security — our people with access to the data are bound by confidentiality. We apply the technical and organisational measures described in the Privacy Policy (Art. 32 GDPR).
- Sub-processors — you authorise us to use the sub-processors listed in the Privacy Policy. We will notify you at least 15 days before adding or replacing one. You may object on reasonable grounds, and if we cannot find a solution, you may terminate the contract. We impose the same data protection obligations on them.
- Assistance — we help you, as far as possible, to respond to data subject requests and to meet your obligations under Articles 32–36 GDPR.
- Personal data breaches — we notify you without undue delay, and no later than 48 hours after becoming aware, with the information available.
- Transfers — any transfer outside the European Economic Area takes place only with the safeguards provided in Chapter V GDPR.
- Deletion or return — on termination, we delete the data under section 18, except data the law requires us to keep. You can export it beforehand on request.
- Audit — we make available the information needed to demonstrate compliance with these obligations and allow a reasonable audit, at most once a year, with 30 days' prior notice, at your expense.
- Business obligations — you have a lawful basis for the processing, you inform your clients (including about the use of GoRage), you enter only necessary and accurate data and you do not enter special categories of data (for example, health data) or national identification numbers.
17. Suspension, restriction and termination
For Drivers
- You can end your relationship with us at any time by deleting your account (section 18).
- We may restrict features, suspend or close an account in the event of a breach of these Terms, fraud, a security risk or a legal obligation. The measure is proportionate and, where possible, we warn you first. You receive a statement of reasons under section 11.
For Businesses
- If we restrict or suspend a Location or your account, we send you the statement of reasons by email before the measure takes effect or, at the latest, when it takes effect.
- If we completely stop providing the Service to you, we give you a reasoned notice at least 30 days in advance. This notice period does not apply if a legal obligation requires us to terminate sooner, if we have an imperative reason under the law, or if you have repeatedly breached these Terms.
- You can clarify the facts through the complaints procedure (section 19). If the measure turns out to be unjustified, we reverse it without delay.
- You can terminate at any time by cancelling the subscription in the Store and, if you wish, deleting the account. If we close the Service, we will notify you at least 30 days in advance.
18. Account deletion
- You can delete your account in the App under Account → Account details → "Delete account", typing the word DELETE to confirm. You can also request deletion at contact@gorage.app or at gorage.app/delete-account.
- The account is deactivated immediately: your profile, Locations and public Content are no longer visible.
- You can restore it by signing in within the next 14 days. After 14 days, the account and associated data are permanently deleted, except data the law requires us to keep (for example, accounting records) or data needed to establish or defend a legal claim, as set out in the Privacy Policy.
- Important: deleting your account does NOT cancel your Store subscription. Cancel it separately from your Apple or Google account, otherwise the Store may keep charging you.
- For a Business account, deletion also covers the client data managed in the Service. Export it beforehand if you need it.
19. Complaints and dispute resolution
- You can send us any complaint free of charge at contact@gorage.app. We reply as soon as possible and within 30 days at the latest. Complaints from Businesses (for example about verification, restrictions, ranking or the Terms) are handled as a priority, usually within 15 working days.
- Consumers — If you are not satisfied with our reply, you can contact the Romanian National Authority for Consumer Protection (ANPC, www.anpc.ro) or use the alternative dispute resolution (SAL) procedure described on the ANPC website. The EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 and is no longer available. Disputes about the service provided by a Business are to be resolved with that Business.
- Businesses — As a small enterprise, we are not required to designate mediators under Article 12 of Regulation (EU) 2019/1150. We are nevertheless willing to attempt mediation in good faith with a mediator authorised in Romania, with a reasonable sharing of costs. Mediation does not limit your right to go to court.
20. Third-party services and availability
- The Service uses third-party services (maps, address search, routing, app stores, sign-in, notifications, hosting, email and SMS), whose terms apply when you use them. We are not responsible for their content or availability. Routes, distances and addresses are for information only.
- We strive to keep the Service available at all times, but interruptions may occur for maintenance or for reasons beyond our control. We may change or withdraw features, and important changes for Businesses are announced under section 23.
21. Warranties and limitation of liability
- The Service is provided "as is" and "as available", to the extent permitted by law. If you are a consumer, you keep all your statutory rights regarding the conformity of digital services, and nothing in these Terms limits them.
- We are not liable for the services and products offered by Businesses, for Content published by users, for errors in data from third parties, or for force majeure events.
- Nothing in these Terms excludes or limits our liability for damage caused intentionally or through gross negligence (Article 1355 of the Romanian Civil Code), for death or personal injury, or in other cases where the law does not allow limitation.
- Towards Businesses, to the extent permitted by law, our total liability for any claim is limited to the amounts paid for the Service in the 12 months before the event and does not cover indirect losses such as loss of profit or loss of clients.
- The Business indemnifies us against third-party claims arising from its services, the Content it publishes, the prices it displays or its breach of the law, including the GDPR as controller.
22. Store-specific terms
Apple App Store
If you downloaded the App from the App Store:
- These Terms are concluded between you and [DENUMIRE SOCIETATE], not with Apple Inc. We, not Apple, are solely responsible for the App and its content. These Terms may not conflict with the Apple Media Services Terms and Conditions.
- The licence is non-transferable and applies to Apple-branded products that you own or control, as permitted by Apple's usage rules, including Family Sharing where applicable.
- Apple has no obligation whatsoever to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims relating to non-conformity are our responsibility.
- We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection or privacy claims.
- We, not Apple, are responsible for the investigation, defence, settlement and discharge of any claim that the App infringes a third party's intellectual property rights.
- Questions, complaints and claims should be sent to the contact details in section 1.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple has the right to enforce them against you.
Google Play
- Google is not a party to these Terms and is not responsible for the App. Purchases through Google Play are also subject to the Google Play Terms of Service and Google's payments policies.
23. Legal compliance and changes to these Terms
- You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government, European Union or United Nations list of prohibited or restricted parties.
- You comply with third-party terms that apply when you use the App, for example your mobile data service agreement.
- We may change these Terms for legal or security reasons or for new features. We will notify you in the App and/or by email at least 15 days before important changes take effect. For Businesses, the notice period is longer if the change requires significant technical or commercial adaptations. Changes do not have retroactive effect.
- If you do not agree, you can end the relationship before the changes take effect, at no additional cost from us. A Business that publishes new Content during the notice period waives the rest of that period, except where significant technical adaptations are needed.
- Changes required by law or by a security risk may take effect sooner.
24. Governing law and jurisdiction
- These Terms are governed by Romanian law.
- If you are a consumer residing in another country, you keep the protection of the mandatory provisions of the law of your country and may bring proceedings in the courts there. If you are a consumer residing in the United States, you keep the rights granted to you by the mandatory law of your state.
- For Businesses, disputes are settled by the competent courts at the registered office of [DENUMIRE SOCIETATE].
25. Final provisions
- These Terms, the Privacy Policy and the Store's terms form the entire agreement between you and us regarding the Service. If a provision is declared invalid, the others remain in force. Our failure to exercise a right does not mean we waive it.
- We may transfer this contract to a company that takes over the Service, after notifying you and without reducing your rights. If you do not agree, you may end the relationship.
- These Terms are available in Romanian and English. Translations into the App's other languages, if any, are for information only. In case of discrepancy, the Romanian version prevails, without affecting your mandatory consumer rights.
- We strive to make the App accessible to people with disabilities. If you encounter an accessibility problem, write to us at contact@gorage.app.
